UPAYA KEMENTERIAN AGAMA DAN PENGADILAN AGAMA KABUPATEN REMBANG DALAM MEMINIMALISIR PERNIKAHAN PADA USIA DINI TAHUN 2021-2022

Abstract

Marriage according to Law No. 16 of 2019 concerning marriage is a physical and spiritual bond between
a man and a woman to live a happy and eternal household based on the Almighty God. Therefore,
marriage must be maintained by both parties in order to achieve the goals of the marriage, so that there
needs to be readiness from both parties, both mentally and materially, meaning that physically men and
women have reached the age limit that can be categorized according to positive law and baligh according to
Islamic law. This research can be categorized as Empirical Research. Empirical Research is research that
obtains data from primary data sources. And this research approach uses an Empirical Juridical approach
by collecting data and primary data information addressed to the Ministry of Religion and the Religious
Court of Rembang Regency. From the results of this study, it can be concluded that the driving factors for
early marriage are as follows: 1) Pregnant Outside of Marriage. 2) Avoiding Adultery. 3) Economy. 4)
Customs and Habits. Efforts of the Ministry of Religion of Rembang Regency. Rembang to minimize
Early Childhood Marriage as follows: 1) Counseling to the community through Officers and Head of
Religious Counselors. 2) Socialization: a) Socialization and guidance to students through madrasahs and
schools by the Head of the Madrasah Education Section and the Head of the Islamic Community
Guidance Section. b) Socialization of the role of parents related to early marriage by the Head of the KUA
and the Head of the Islamic Community Guidance Section. 3) Guidance: a) Guidance for Prospective
Brides and Grooms by the KUA, Head of the Islamic Community Guidance Section of the Ministry of
Religion and Officers of the Religious Court Representative. b) Guidance activities for students by the Head
of the Islamic Community Guidance Section of the Ministry of Religion. As well as the efforts of the
Rembang Regency Religious Court which is the last link in the child marriage process is to tighten
administrative requirements, provide explanations, explore the child's true wishes and see the true benefits
and disadvantages of child marriage related to the Marriage Dispensation application. The Religious Court
is also still building cooperation with related parties such as NU and Muhammadiyah community
organizations, and together with the Ministry of Religion provides guidance related to increasing knowledge
of early marriage
