EFEKTIFITAS TRANSPARANSI PENGELOLAHAN TANAH BENGKOK/KAS DESA DI KECAMATAN SARANG KABUPATEN REMBANG

Abstract

Land as one of the natural resources that plays an important role in human life, which is used as a place
to live, a place of business, agricultural land and the construction of public facilities. The use of land by
humans must also pay attention to its territorial space to maintain the balance between humans and
nature. Humans and land are two things that cannot be separated, because human life cannot be
separated and separated from land. The greater the need for humans to utilize land, the more legal
certainty is needed to prevent problems that arise in the future. In Article 1 number 1 of the Regulation of
the Minister of Home Affairs of the Republic of Indonesia Number 1 of 2016 concerning Village Asset
Management. It is determined that a village is a legal community unit that has territorial boundaries that
is authorized to regulate and manage government affairs, the interests of the local community based on
community initiatives, original rights, and/or traditional rights that are recognized and respected in the
government system of the Republic of Indonesia. Villages as a legal community unit that has the authority
to regulate and manage the interests of the local community with an original structure based on original
rights and local customs that are recognized in the national government system and are located in special
district areas. So in Rembang Regency itself, Regent Regulation Number 4 of 2022 concerning Guidelines
for Financial Assistance to Villages for the Utilization of Village Land for Public Facilities in the Form
of Village Land Compensation Funds was stipulated. The regulation was made with the intention in
article (2) to provide guidelines for providing financial assistance to Villages for the utilization of village
land for public facilities in the form of village land compensation funds, local community interests based on
community initiatives, original rights, and/or traditional rights that are recognized and respected in the
government system.
